In North Carolina, when you hire a realtor, you are hiring a person who has fiduciary duties to you.
“Fiduciary” means trust, and a person with a fiduciary duty has a legal obligation to maintain that trust. For example, lawyers have a fiduciary duty to act in the best interest of their clients.
NC Realtors have Six Fiduciary Duties to their clients: Loyalty. Reasonable Care and Diligence. Confidentiality. Accounting. Disclosure. Obedience.
Overwhelmingly, buyers are represented by their own agents-realtors (as are sellers). Buyers need an agent's expertise and education, guidance and advocacy.
Buyers are responsible for hiring and paying their broker agent's commission. Buyers have always paid their broker's commission indirectly by way of their purchase funds. In 2024, we can expect that more and more sellers will opt NOT to pay the buyer agent's commission. The buyer will be expected to bring those funds to the closing table.
